Made In Italy Property Group Pty Ltd ("Made In Italy", "we", "us", "our") operates the website at https://madeinitaly.com.au and provides Italian restaurant, pizza and pasta delivery services across Sydney, NSW, Australia.

By placing an order, using our website, or participating in our loyalty program, you agree to these Terms and Conditions. Please read them carefully before ordering.

Made In Italy Property Group Pty Ltd is an Australian company operating Italian restaurants and delivery services in Sydney, NSW. Our online ordering platform is available at https://orderonline.madeinitaly.com.au and through the Made In Italy app.

2. Ordering

2.1 Placing an Order

By submitting an order through our website, app, or ordering platform, you make an offer to purchase the items selected. We reserve the right to accept or decline any order. A contract is formed when we confirm your order and accept payment.

2.2 Minimum Order

A minimum order value of $25 applies to all delivery orders.

2.3 Order Accuracy

Please review your order carefully before submitting. Once an order is confirmed and in preparation, we may not be able to make changes or cancellations. Contact us as soon as possible if you need to amend an order.

2.4 Cancellations and Refusals

Made In Italy reserves the right to cancel or refuse any order where:

  • suspicious activity is detected by any staff member;
  • items are unavailable;
  • payment cannot be processed; or
  • the delivery address is outside our delivery zone.

Where an order is cancelled by us, you will receive a full refund via your original payment method.


3. Pricing and Surcharges

3.1 Prices

All prices displayed on our menu include GST. Prices are subject to change without notice.

3.2 Surcharges

The following surcharges apply:

  • Half/Half Pizza: A $1 surcharge applies to all half/half pizza orders.
  • Extra Toppings and Substitutes: Additional charges apply for extra toppings or substitutions as displayed on our menu.
  • Public Holidays: A 12.5% surcharge applies to all orders placed on NSW public holidays.
  • Credit Card Payments: A 1.5% surcharge (including GST) applies to all credit card transactions (Visa, Mastercard, and Amex).
  • Online Service Fee: A 1.5% service fee applies to all online orders.

3.3 Payment Methods

We accept Visa, Mastercard, and American Express. Payment is processed securely through our third-party payment provider. We do not store your full card details.


4. Delivery

4.1 Delivery Area

Delivery is available to selected suburbs in Sydney. Please check our website for current delivery zones and estimated delivery times.

4.2 Delivery Times

Estimated delivery times are provided as a guide only and may vary due to demand, traffic, and other factors outside our control. We do not guarantee delivery within a specific timeframe.

4.3 Your Responsibilities

To assist with a smooth delivery, please:

  • ensure your delivery address is correct and complete at the time of ordering;
  • leave a light on or be available at your address when expecting a delivery; and
  • ensure someone is available to receive the order.

We are not responsible for failed deliveries resulting from an incorrect address or no one being available to receive the order.

4.4 Free Delivery

Free delivery applies to orders over $50 (after discounts). Orders below $50 may incur a delivery fee as displayed at checkout.


5. Food Safety, Allergens and Dietary Requirements

5.1 Allergens

Made In Italy will endeavour to accommodate allergen and gluten-free requests. However, our kitchens handle a wide range of ingredients including gluten, dairy, eggs, nuts, seafood, and soy. We cannot guarantee that any item is completely free from allergens due to the risk of cross-contamination during food preparation and cooking.

If you have a severe allergy, please contact us directly before ordering.

5.2 Gluten Free

We offer gluten-free options, but we cannot guarantee a 100% gluten-free environment. Cross-contamination may occur.

5.3 Vegan and Plant-Based Items

We offer vegan menu items. However, traces of meat or dairy products may be unintentionally present due to cross-contamination during store operations. We cannot guarantee that vegan items are 100% free from animal products.

5.4 Olives

Olives served in our menu may contain pits or pit fragments.

5.5 Food Standards

Our food is prepared in accordance with the Food Act 2003 (NSW) and the Australia New Zealand Food Standards Code.


6. Australian Consumer Law

Our goods and services come with consumer guarantees under the Australian Consumer Law (ACL), being Schedule 2 of the Competition and Consumer Act 2010 (Cth). Nothing in these Terms and Conditions limits, excludes, or modifies any right or remedy you have under the ACL that cannot lawfully be excluded.

Where a consumer guarantee applies and we fail to meet it, you may be entitled to a replacement, refund, or compensation. Please contact us as soon as possible if you are not satisfied with your order.


7. Refunds and Complaints

If your order is incorrect, unsatisfactory, or not delivered, please contact us promptly with your order details and a description of the issue. We will assess your complaint and, where appropriate, offer a remedy including a replacement order, store credit, or refund.

Refunds will be processed via your original payment method and may take 3-5 business days to appear depending on your bank.


8. Loyalty Program

8.1 Earning Stamps

To earn a stamp, your order must be $20 or more (after any discounts are applied). Stamps are awarded for orders placed through the Made In Italy app or at https://orderonline.madeinitaly.com.au only. Phone orders and orders placed through third-party platforms (e.g. Uber Eats, DoorDash) are excluded.

8.2 Rewards

Collect 5 stamps and a $15 voucher will be automatically credited to your account.

8.3 Voucher Use

  • Vouchers must be used in a single order and cannot be split across multiple orders.
  • Any unused voucher value is forfeited.
  • Vouchers expire 1 month after the date of issue.
  • Vouchers have no cash value and cannot be transferred.

8.4 Store Independence

Each Made In Italy store operates independently. Stamps are counted per store and cannot be combined across locations.

8.5 Eligibility

The loyalty program is available to registered account holders only. You must be 18 years or older to participate.

8.6 Program Changes

Made In Italy reserves the right to modify, suspend, or end the loyalty program at any time. Where we choose to end the program, we will provide 8 weeks' notice. It is your responsibility to redeem any stamps or vouchers before the program ends. We are not liable for any unredeemed stamps or vouchers after the program ends.


9. Intellectual Property

All content on our website and app, including text, images, logos, graphics, and menu designs, is owned by or licensed to Made In Italy Property Group Pty Ltd. You may not reproduce, copy, distribute, or use any of our content without our prior written consent.


10. Website Use

10.1 Acceptable Use

You agree to use our website and ordering platform only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

  • attempt to gain unauthorised access to any part of our website or systems;
  • use our website to transmit spam, malicious code, or harmful content; or
  • scrape, copy, or harvest data from our website without our consent.

10.2 Third-Party Links

Our website may contain links to third-party websites (including delivery platforms and payment providers). We are not responsible for the content or practices of those websites. Visiting them is at your own risk.

10.3 Availability

We aim to keep our website and ordering platform available at all times, but we do not guarantee uninterrupted access. We may need to suspend the platform for maintenance or updates without notice.


11. Limitation of Liability

To the maximum extent permitted by law, Made In Italy's liability to you for any claim arising out of or in connection with your use of our website or your order is limited to the value of that order.

We are not liable for any indirect, consequential, incidental, or special loss or damage arising from your use of our website or ordering platform, including loss of data or loss of profits.

Nothing in these Terms limits your rights under the Australian Consumer Law.


12. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.


13. Changes to These Terms

We may update these Terms and Conditions from time to time. Updated terms will be posted on this page with a revised date. Your continued use of our website or services after any changes constitutes your acceptance of the updated terms.
